These Terms of Use (we will call them the “Terms”) are a legal agreement between you and Did It Today, which is the product and service offered under TwoCrazies Creations Limited (also referred to as “we,” “us,” “our,” or the “Company”). These Terms govern your use of our website, our reading materials, our quizzes, and all other services we provide (collectively called the “Services”).

Please read these Terms carefully. They contain important information about your legal rights. They also explain how your subscription works, how payments are processed, and how renewals happen.

By creating an account, buying a subscription, or simply using our website, you agree to follow these Terms. If you do not agree with any part of these Terms, you must stop using the website immediately.

We provide these Services from the Asia Pacific region. By using our site, you acknowledge that you are entering into a contract with us electronically. This contract is just as valid as a paper contract that you sign with a pen.

2.  Definitions

To make these Terms easy to understand, we have defined some key words below.

● “Account” refers to the personalized access area you create on our website. This allows you to manage subscriptions, view progress, and access content.

● “Adult” means a person who is 18 years of age or older. 

● “Child” or “Student” means the person under the age of 18 who uses the educational parts of the website to read stories and take quizzes.

● “Content” means all the text, stories, images, audio, quizzes, badges, layout, code, and software found on the website. 

● “Parent” or “Subscriber” means the Adult who registers the Account and pays for the Service. 

● “Subscription” means the paid plan that gives you access to the Content for a specific period of time. 

● “Subscription Period” means the length of time your Subscription lasts (for example, one year).

3.  Eligibility and Account Registration

3.1 Age Requirements

Our website is an educational tool for children, but our business relationship is with adults. You must be at least 18 years old to create an account or purchase a subscription.

By registering, you promise that:

1)  ​You are an Adult (18 years or older).

2)  ​You have the legal power to enter into a binding contract.

3)  ​All information you provide to us is accurate, current, and complete.

3.2 Parental Responsibility

If you are a parent or legal guardian, you may allow your child to use the website to read and learn. However, the Account belongs to you, not the child.

You accept full responsibility for your child’s use of the Services. You agree to supervise your child to ensure they use the website safely and correctly. If your child violates these Terms, we will hold you responsible. It is your job to explain these rules to your child in a way they can understand.

3.3 Account Security

You are responsible for keeping your username and password safe. You must not share your password with anyone outside of your immediate household.

You are responsible for all activity that happens under your Account. This includes activity by your child or activity by someone who guessed your password because it was too weak. If you believe someone has stolen your password or accessed your account without permission, you must notify us immediately.

We will not be responsible for any loss or damage that results from your failure to secure your password.

4.  Description of Services

4.1 What We Provide

Did It Today is an online learning platform. We provide grade-level reading passages and comprehension quizzes designed to help students practice their reading skills. We also provide tracking tools so parents can see how much their child has read and how well they scored on quizzes.

4.2 Educational Disclaimer

Our goal is to help children improve their reading confidence and comprehension. However, every child is different.

We do not guarantee any specific results. We do not promise that using our website will result in better grades at school, higher test scores, or a specific level of reading fluency. Our Services are meant to be a practice tool. They should not replace formal schooling or professional educational therapy.

4.3 Service Availability

We try our best to keep the website running 24 hours a day, 7 days a week. However, sometimes things happen that are out of our control.

We do not guarantee that the website will always be available. We may experience downtime due to:

● Technical failures or server crashes. 

●  Maintenance or updates to improve the site.

●  Internet outages or problems with your local connection.

● Events beyond our control, such as natural disasters.

We are not liable for any inconvenience or loss caused if you cannot access the website for a short period.

5.  Subscriptions, Billing, and Payments

This section is very important. Please read it carefully to understand how you will be charged.

5.1 Subscription Plans

We offer different subscription tiers, such as the “Daily Reader” and the “Super Reader.” Each plan offers different features, such as a different number of stories available per day. You can view the current features and prices on our Pricing page.

5.2 Upfront Billing

Although we may display the price as a “monthly cost” to help you compare value (for example, “$2.99 per month”), all plans are billed as a single upfront payment.

When you purchase a 12-month plan, you will be charged the full amount for the entire year immediately. 

● You cannot choose to pay monthly.

● You pay for the full Subscription Period in advance.

5.3 Automatic Renewal

To ensure uninterrupted access to the Services, subscriptions are set to Auto-Renew by default.

At the end of your Subscription Period, your subscription will automatically renew for another Subscription Period of the same length. We will charge the payment method we have on file for the current price of the plan.

By purchasing a subscription, you authorize us to process this automatic charge annually.

5.4 Free Trials

We may offer a 7-day free trial to new users.

● Requirement: You must provide a valid payment method (like a credit card) to start the trial. 

● No Charge During Trial: You will not be charged during the 7-day period. 

● Automatic Conversion: If you do not cancel before the trial ends, the system will automatically begin your Subscription Period and charge the full annual amount. 

● Your Responsibility: It is your responsibility to track when your trial ends. We are not required to send a reminder email before the charge occurs. 

5.5 Price Changes

We reserve the right to change our prices at any time. If you have an active subscription, any price change will only apply after your current Subscription Period ends. We will notify you in advance if the price will increase for your next renewal. If you do not agree with the new price, you can cancel your subscription before it renews.

6.  Cancellation and Refund Policy

We want to be completely transparent about how cancellations and refunds work.

6.1 How to Cancel

You can cancel your subscription at any time. You can do this by logging into your Account settings on the website or by contacting our customer support team.

Please note:

● We do not provide a separate button to “turn off auto-renewal.”

● The only way to stop auto-renewal is by cancelling your subscription.

● Once you cancel, your subscription will remain active until the end of your current Subscription Period. After that, it will not renew.

6.2 No Refunds for Partial Periods

Our Service is billed in advance. We do not offer refunds for unused portions of the Subscription Period.

If you cancel before the Subscription Period ends:

1. You will not receive a refund for the remaining months.

2. Your subscription will not renew after it expires.

3. You will retain full access until the Subscription Period ends.

6.3 Refund Exceptions

We only provide refunds in very specific situations required by law, or if there was a technical billing error on our side (such as being charged twice for the same plan). We do not provide refunds because you forgot to cancel a free trial, or because you simply decided you no longer use the website.

7.  User Conduct

We want to maintain a safe and fair environment for all students. By using the website, you agree to follow these rules.

7.1 Prohibited Activities

You agree that you will NOT:

● Cheat: Use answer keys found elsewhere or use automated tools to answer quizzes.

● Share Accounts: Allow people outside your home to use your login details.

● Copy Content: Copy stories, images, or quizzes to share on other websites or to print and sell.

● Harm the Site: Upload viruses, malware, or bad code that could hurt the website.

● Hack: Try to break into our security systems or access data that does not belong to you. 

● Scrape: Use “bots,” “spiders,” or “scrapers” to download our content automatically.

●  Impersonate: Pretend to be someone else, such as a teacher or a Did It Today employee.

7.2 Interactions with Others

If the website allows users to post comments or interact (now or in the future), you agree to be respectful. You will not post anything that is:

● Bullying or harassing. 

●  Hateful or racist.

●  Inappropriate for children.

● False or misleading.

We have the right to remove any content you post if we think it violates these rules. We also have the right to ban your account if you break these rules.

8.  Intellectual Property Rights

8.1 Our Ownership

Everything you see on didittoday.com is the property of Did It Today or our licensors. This includes:

● The reading passages and stories.

● The quiz questions and answers.

● The design, logo, and “look and feel” of the site.

● The software code that makes the site work.

These materials are protected by copyright laws, trademark laws, and other intellectual property laws.

8.2 Your License

When you pay for a subscription, you are not buying the content. You are paying for a “license” to use it.

We grant you a limited, non-exclusive, non-transferable license to use the website for personal, non-commercial use only.

This means:

● You Can: Read the stories on your screen, take the quizzes, and view your progress. 

● You Can Not: Print the stories to sell them. You cannot copy the stories and put them on your own blog. You cannot use our stories to teach a class where you charge money (unless you have a specific commercial agreement with us). 

8.3 Feedback

If you send us ideas, suggestions, or feedback about how to improve the website, we are free to use those ideas. We do not owe you any money or credit for using your suggestions. By submitting feedback, you grant us full ownership of those ideas.

9.  Privacy and Data Collection

Your privacy is very important to us, especially because our service is used by children.

● WE DO NOT PROMISE THAT THE WEBSITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

● WE DO NOT PROMISE THAT THE RESULTS YOU GET FROM USING THE WEBSITE WILL BE ACCURATE OR RELIABLE. 

● WE DO NOT PROMISE THAT ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED IMMEDIATELY.

● WE DISCLAIM ANY IMPLIED WARRANTIES OF MERCHANTABILITY (QUALITY) OR FITNESS FOR A PARTICULAR PURPOSE.

You use the website at your own risk. If the website causes a problem with your computer or if you lose data, you are responsible for that.

12.      Limitation of Liability

● Service interruptions or computer failure. 

● Emotional distress or inconvenience.

This applies even if we have been advised that such damages might happen.

Financial Limit: If we are found liable for any reason, our total liability will not exceed the amount you paid during the Subscription Period immediately before the event giving rise to the claim.

If you have not paid us any money (for example, if you are on a free trial), our total liability to you is limited to $100 (or the equivalent in your local currency).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. Accordingly, some of the above limitations may not apply to you. In such cases, our liability will be limited to the greatest extent permitted by applicable law.

13.      Indemnification

You agree to defend, indemnify, and hold harmless Did It Today and our employees, contractors, agents, officers, and directors.

This means that if someone sues us or claims damages because of something you did, you agree to pay for our legal defense and any damages we have to pay.

You must indemnify us for claims arising from:

1)  ​Your use or misuse of the Service.

2)  ​Your violation of these Terms.

3)  ​Your violation of any applicable law or regulation.

4)  ​Your violation of the rights of a third party, such as intellectual property rights.

5)  ​Any activity that happens under your username and password.

We reserve the right to take over the exclusive defense of any matter subject to indemnification by you. In that case, you agree to cooperate with our defense.

14.      Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and interpreted according to the laws of the jurisdiction where the Company is officially incorporated and registered within the Asia Pacific region. This applies without regard to conflict of law principles.

14.2 Amicable Resolution

If you have a problem or a dispute with us, you agree to contact us first and try to resolve the issue informally. You can contact us at our support email. We will try our best to resolve your concern fairly and quickly.

14.3 Arbitration

If we cannot resolve the dispute informally, any claim or controversy arising out of these Terms or the Services shall be settled by binding arbitration.

Arbitration means that a neutral third party will decide the outcome, rather than a judge or jury in court. You agree that:

1)  ​You are waiving the right to a trial by jury.

2)  ​You are waiving the right to participate in a class action lawsuit or class-wide arbitration. You may only bring claims on your own behalf.

The arbitration will take place in a location mutually agreed upon or via online dispute resolution platforms, conducted in the English language.

15.      Changes to These Terms

We may update these Terms from time to time. This might happen because we change our business model, or because laws change.

If we make material changes, we will try to notify you. This could be via an email to the address on your account, or a prominent notice on the website.

The “Last Updated” date at the top of this page will tell you when the latest changes were made.

If you continue to use the website after the changes become effective, it means you agree to the new Terms. If you do not agree to the new Terms, you must stop using the website and cancel your subscription.

16.      Termination

16.1 Termination by You

You may stop using the Services at any time. You may cancel your subscription as described in Section 6.

16.2 Termination by Us

We have the right to suspend or terminate your account and your access to the website at any time, without prior notice, for any reason.

Most often, we would do this if:

● You violate these Terms.

●  We suspect fraud or illegal activity.

● We decide to stop providing the Service entirely. 

●  You fail to pay your subscription fees.

If we terminate your account because you broke the rules (violated the Terms), you will not receive a refund.

All provisions of these Terms that should survive termination will remain in effect even after your account is closed. This includes Ownership, Warranty Disclaimers, Indemnity, and Limitations of Liability.

17.      Severability and Entire Agreement

17.1 Severability

If any part of these Terms is found to be illegal or unenforceable by a court or arbitrator, that specific part will be removed. However, the rest of the Terms will remain in full force and effect. The removal of one bad clause does not ruin the whole contract.

17.2 Entire Agreement

These Terms, along with our Privacy Policy and any specific guidelines posted on the website, constitute the entire agreement between you and Did It Today. They replace any prior agreements or conversations we may have had.

17.3 Waiver

If we fail to enforce a rule in these Terms, it does not mean we have given up our right to enforce it later. For example, if you miss a payment and we do not ban you immediately, we can still ban you later if you continue to not pay.

18.      Force Majeure

We shall not be liable for any failure to perform our obligations where such failure results from any cause beyond our reasonable control.

This includes, but is not limited to:

● Mechanical, electronic, or communications failure or degradation. 

● Acts of God (earthquakes, floods, storms).

● Pandemics or health emergencies.

●  War, terrorism, or riots.

● Government actions or embargoes.

● Strikes or labor disputes.
